Every individual should have a Last Will and Testament setting forth what and to whom they wish to distribute their estate. Sometimes it is appropriate to have a trust to facilitate the transfer of assets. This can often save significant estate taxes.
In some cases, it is possible that children from a first marriage will receive nothing without a Last Will and Testament.
If there is no Last Will and Testament, then the Wisconsin Statutes set forth how property is to be distributed. This oftentimes is not what individuals really want to occur.
